OkeyStay

Terms of use

The conditions that govern the use of OkeyStay, for hosts and travellers. The accommodation contract is made between the traveller and the host; OkeyStay provides the listing, the booking and the payment.

1. Who we are

OkeyStay is a platform operated by ActiveNetwork Global SL, tax ID (CIF) B93372217, with registered address at Decano Manuel Domínguez, 12, 29140 Churriana (Málaga), Spain. Contact: okeystay.com/en/contact. Registered in the Málaga Companies Register, Volume 5353, Book 4260, Folio 62, Sheet MA-126151, Entry 1.

2. What OkeyStay is and is not

OkeyStay is a portal where hosts list holiday rentals and travellers search, compare and book them.

The accommodation contract is made between the traveller and the host. OkeyStay provides the listing, the booking and the payment, and is not the owner or the manager of the accommodation, unless expressly stated otherwise.

The experiences and activities shown are booked with third parties (for example, Viator) under their own conditions.

3. Acceptance and changes

By registering or using the service you accept these terms. We may amend them; we will publish the new version with its date and give notice of important changes. If you keep using the service, you are deemed to accept them.

4. Account

You must be of legal age and have legal capacity. Your registration details must be true and up to date.

You are responsible for your account and for what is done from it. Let us know if you detect any unauthorised use.

One person or entity, one account, unless we agree otherwise.

5. Conditions for hosts

5.1 Your obligations. As a host you declare and undertake that:

  • you have the right to rent the accommodation (ownership, mandate or management);
  • you hold the licences, registrations and authorisations required by the regulations of your country and locality, and you show them in the listing (for example, the tourist registration number);
  • the information, photos, description, price, calendar and house rules are true and up to date;
  • you state whether you act as a professional (company, self-employed or manager) or as a private individual; OkeyStay will show this to the traveller so they know who they are contracting with;
  • you meet your obligations regarding taxes, guest registration, safety, the owners' association and consumer law;
  • you do not list the same accommodation in a way that causes double bookings; you keep the calendar up to date or synchronised.

5.2 Import and synchronisation. If you import listings or synchronise calendars from other platforms, you declare that you have the right to do so and that you comply with the conditions of those platforms. OkeyStay is not responsible for changes those platforms may introduce.

5.3 Content. You keep ownership of your texts and photos. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, translate, optimise for search engines and AI assistants, and display them while your listing is active. When you close your account, your listing stops showing immediately; we keep your content for 30 days in case you want to reactivate it and then delete it, except for what the law requires us to keep (for example, invoices and past bookings) or what is needed to resolve a dispute. The licence ends with the account closure, subject to those exceptions. Content already published in search engines or in AI assistant answers may take time to disappear, because that depends on third parties. You warrant that you hold the rights to that content.

5.4 Optimisation and AI agents. We may rewrite, summarise or translate your listings and display them through AI agents, an llms.txt file, Markdown versions and a public read-only MCP so that AI assistants can consult them. The AI agent for each property answers traveller queries with the information in your listing: it can make mistakes, which is why you must review and keep the data correct. Before publishing, the host can review and edit each property in their dashboard (okeystay.com/en/host) and change it at any time. The dashboard includes an area to communicate with the AI agents: when an agent does not know something about the property, it asks the host directly, and those answers improve the agent's knowledge of that accommodation. The host's answers are used to improve the agents of that property only and are not shared with those of other hosts. Only non-personal information would be used to improve the service in general, and we would tell you clearly.

5.5 Commissions.

  • Listing is free, with no monthly fee and no lock-in.
  • We charge a commission per booking on the total paid by the traveller: 15% on the free standard plan and 10% on the Pro plan. You are Pro while you have HostFlow (hostflowstays.com), OceanPrice (ocean-price.com) or both. The commission applied to each booking is that of the plan you have at the time that booking is paid. If you cancel HostFlow and OceanPrice, you go back to 15% on new bookings; those already paid keep 10%. The commission is calculated on the total the traveller pays, all included. Example (standard plan): the traveller pays €1,000; €850 go directly to the host's account and €150 to OkeyStay's (on the Pro plan, €900 and €100).
  • The traveller pays the booking and the amount arrives directly in the host's Stripe account. The platform commission is applied within that same payment through Stripe. OkeyStay issues a monthly invoice for the commission, with the detail of each booking, available in your dashboard. To invoice correctly you must provide your country and your tax/VAT number at sign-up. VAT: the commission percentages (15% and 10%) already include VAT, where applicable; nothing else is added. The monthly invoice will break down the base and VAT where appropriate. If you are a company from another country and give us a valid VAT number, and the rules allow it, the invoice may be issued without Spanish VAT so that you self-assess it in your country; in that case the commission remains the same percentage.
  • We may agree different conditions in writing with a specific host.
  • Rate changes: we will give you 30 days' notice by email and in your dashboard; if you disagree, you can close your account before they take effect. They will not affect bookings already paid, which keep the commission with which they were paid. Commission reductions may apply immediately.

5.6 Payments. The traveller's payment is processed through Stripe, which has its own terms. You must complete the verification Stripe requires in order to receive payments. The timing of payouts, holds, refunds and payment disputes is governed by Stripe according to its relationship with you. When a traveller must be refunded under the cancellation policy (section 15), the refund is funded by both parties in the same proportion in which the payment was split: the host returns its part and OkeyStay returns its part. Example: a €1,000 booking cancelled with a full refund; the host returns €850 and OkeyStay €150. With a 50% refund (€500), the host returns €425 and OkeyStay €75.

5.7 Accounting. OkeyStay makes available to you the accounting detail of the bookings made on the platform, with the commission applied to each one. It is supporting information: it does not replace your own accounting or your tax obligations.

5.8 Host cancellations. If you cancel a confirmed booking without justified cause, the traveller receives a full refund, you undertake to help find an alternative, and OkeyStay may apply the consequences set out in section 15.

5.9 Off-platform. You are free to sell your accommodation through your own channels and on other platforms, and to set your prices. The only thing you may not do is use a traveller's contact details obtained through OkeyStay to close that same booking off-platform and so avoid the commission.

6. Conditions for travellers

The price shown includes the nights and the cleaning stated; OkeyStay does not charge the traveller a service fee. Any applicable tourist taxes or local taxes are shown before payment, on a separate line, stating whether they are included in the total or paid at the accommodation. Each host states which is the case for their locality and is responsible for complying with local rules.

When you book, you enter into an accommodation contract with the host; their house rules and the cancellation policy stated in the listing apply. If the host does not choose another, the standard policy in section 15 applies.

Payment is made on OkeyStay and processed by Stripe. You will receive confirmation by email.

Bookings started from AI assistants. An assistant (ChatGPT, Gemini, Perplexity, Grok or another) may show you accommodation and prepare a booking link with dates and guests. The assistant does not pay for you: you make the payment and the confirmation on OkeyStay. The information an assistant shows may be out of date or incorrect; what prevails is what you see on OkeyStay before paying.

If you are a consumer, you keep the rights granted to you by the law of your country of residence. Bookings of accommodation for a specific date have no right of withdrawal, unless the applicable law grants it; the cancellation policy stated in the booking does apply. For questions or complaints, write to us at okeystay.com/en/contact.

7. Keys programme

1 Key = €1 discount on eligible OkeyStay bookings. In general, Keys are not money and cannot be withdrawn in cash; the only exception is the euro redemption for associations, real-estate agencies, real-estate agents and partner companies set out in 7.8.

Travellers: 2 Keys for every €100 of eligible bookings while signed in. Hosts who refer: 1 Key for every €100 of the referred host's bookings, on each booking.

Keys are pending and become active 48 hours after check-out, with the booking confirmed. Cancelled or refunded bookings do not earn Keys. Bookings without an account do not earn Keys.

Each invitation is attributed to the first valid referrer and cannot be reassigned. Self-invitations do not count.

Keys do not expire while the account meets the programme conditions. The ability to redeem them is being rolled out in phases.

Rewards for services (hosts): if the host you invite subscribes to HostFlow or OceanPrice, you receive a commission each time that host pays for those services: 20% during the first 3 months, 7% afterwards, and 10% permanently once you reach 25 active referrals. Conditions: (a) it is paid once a month, once 30 days have passed since the referral's payment; (b) there is a €20 minimum to pay out and anything below it accumulates; (c) you can receive it by transfer via Stripe or in Keys; (d) an active referral is one who has a current service or has paid for one in the last 60 days; (e) if the referral obtains a refund, the corresponding commission is deducted; (f) taxes and invoicing: if you are a company or self-employed, to be paid in cash you will have to issue us an invoice with your tax details; if you are a private individual without economic activity, the reward is paid in Keys. OkeyStay will apply any withholdings required by law.

We may modify or end the programme and cancel Keys obtained through fraud or abuse.

7.8 Euro redemption for associations, real-estate agencies, real-estate agents and partner companies. Tourism-sector associations, real-estate agencies and agents (self-employed professionals or companies) and other partner companies that have a collaboration agreement with OkeyStay and their own invitation link earn Keys on the bookings of hosts who register with that link (1 Key per €100 of booking) and may redeem them for euros, at 1 Key = €1. Conditions: (a) Keys are credited and become available 48 hours after check-out of each confirmed booking; cancelled or refunded bookings do not earn Keys and, if already redeemed, their amount is deducted from later redemptions; (b) redemption is once a month and from a minimum of €20; smaller amounts accumulate; (c) redemption is made against an invoice from the association, agency, agent or company to ActiveNetwork Global SL with its tax details, or the document required by its legal form, and is paid by bank transfer within 24–48 hours of receipt; (d) OkeyStay will apply any withholdings and taxes required by law; (e) this option requires a prior written agreement and is not available to travellers or private-individual hosts, who keep receiving Keys as a discount on bookings; (f) we may modify or end this redemption with 30 days' notice, without affecting Keys already credited.

8. Acceptable use

The following is not allowed: publishing false or illegal information; impersonating others; using the platform for unlawful activities; interfering with its operation; or extracting data in bulk or automatically except through the means OkeyStay offers for AI assistants (llms.txt, Markdown, public MCP) and respecting their limits. Use of the MCP and of llms.txt is free and open, subject to reasonable use: OkeyStay may limit the request rate, or block abusive access, to protect the service and its stability.

9. Intellectual property

The design, code, texts and trade marks of OkeyStay belong to ActiveNetwork Global SL or to those who have authorised us to use them. The photos and descriptions of each accommodation belong to its host or to whoever holds the rights. They may not be reproduced without authorisation.

10. Liability

We strive to keep the information accurate and current, but we do not guarantee it is free of errors. Price and availability depend on each property's calendar and may change.

OkeyStay is not a party to the accommodation contract and is not liable for the quality, safety, legality or condition of the accommodation, nor for the acts or omissions of hosts and travellers, except where the law does not allow such exclusion.

We are not liable for third-party sites or services linked to (Stripe, Viator, platforms you import from, etc.).

Hosts (business-to-business relationship): OkeyStay's total liability towards a host for any cause is limited to the commissions you have paid to OkeyStay in the preceding 12 months, with a minimum of €500, except for wilful misconduct or gross negligence or what the law does not allow to be limited. Travellers (consumers): liability is not limited where the law prohibits limiting it. Neither party is liable for force majeure.

11. Suspension and account closure

You can close your account at any time. We may suspend or cancel accounts or listings that breach these terms, the law, or for security reasons, with reasonable notice except in an emergency. We will tell you in writing the reasons for any restriction, suspension or cancellation of your host account, and if we cancel your account without any breach on your part, we will do so with 30 days' notice. Regarding bookings already confirmed:

  • Host: cannot close their account with future paid bookings until they are fulfilled or cancelled; if they are cancelled, the policy in section 15 applies.
  • Traveller: closing the account does not cancel their booking, which remains in force under its cancellation policy.
  • Suspension by OkeyStay: confirmed bookings are honoured or fully refunded, and we will try to relocate the traveller.

12. Personal data

We process your data as explained in the Privacy policy (okeystay.com/en/privacy).

13. Governing law and jurisdiction

These terms are governed by Spanish law, without prejudice to the rights consumers may have under the law of their country of residence. For disputes with hosts (companies or professionals): the courts of Málaga. For consumer travellers: those that correspond by law to their domicile. Before going to court, both parties may contact OkeyStay (okeystay.com/en/contact) to try to resolve the matter.

14. Contact

For any question about these terms, write to us at okeystay.com/en/contact.

15. Cancellation and refund policy

15.1 The host chooses a policy for each property, visible before payment and in the confirmation:

  • Flexible: 100% refund if the traveller cancels up to 3 days before arrival.
  • Moderate (standard if the host does not choose): 100% up to 14 days before; 50% up to 7 days before; after that, no refund.
  • Strict: 50% up to 30 days before; after that, no refund.

The policy in force is the one shown to the traveller at the time of booking; later changes do not affect them.

15.2 Cancellation by the host: 100% refund to the traveller and help finding alternative accommodation. Consequences for the host: first time, a warning; second, those dates are blocked in the calendar; if it keeps happening, the listing is suspended.

15.3 The accommodation does not match the listing (no access, serious differences, a serious safety or cleanliness problem): the traveller notifies the host and OkeyStay within 24 hours of arrival, with evidence. The host has an opportunity to fix it; if it is not resolved, OkeyStay mediates and may propose a full or partial refund, or relocation.

15.4 Force majeure and extraordinary circumstances (natural disasters, official travel restrictions, etc.): handled case by case.

15.5 Deposit or damage: for now there is no deposit. The host may claim demonstrable damage directly from the traveller.

15.6 Refunds: made by the same means of payment, within Stripe's and the bank's timeframes. OkeyStay returns the commission part that corresponds to it in the same proportion as the refund (see 5.6).

15.7 These conditions are without prejudice to the consumer rights that the law grants the traveller.
