Check your home is within scope
Tourist dwellings are regulated as a tourist accommodation service, and registration in the Andalusian Tourism Register is mandatory and will be communicated to the local council.[3]
Homes let without payment and rentals for more than two continuous months to the same tenant are excluded. Homes under public protection cannot be tourist dwellings.[3]
Habitual letting is presumed if you advertise or if the service exceeds, in total, one month in the same year; tourist purpose is presumed when marketed on tourist channels, including booking websites.[1]
Know the rules that apply
The applicable framework is Decree 28/2016 on tourist dwellings (consolidated text) and the Andalusian Tourism Act; other sectoral decrees may also apply.[1][2][3]
Register online: responsible declaration
To start the service, the operator must submit a responsible declaration electronically to the competent tourism department, using a digital certificate.[1][3]
Filing the declaration fulfils the duty to register and allows you to begin; the entry receipt proves submission. Registration is free.[1][2]
When the online process finishes, the home is registered and assigned a code in the format VUT/XX/00000, which must appear in all advertising, including online.[1]
Providers legally established in other Autonomous Communities who operate in Andalusia temporarily under free provision are not obliged to register.[2]
Prepare your information and documents
The declaration must include the dwelling’s identification (including cadastral reference and maximum capacity), the operator’s identification and legal title with phone and email, and a statement of urban-planning compatibility.[3]
Indicate your operating periods in the declaration; any changes must be notified with the communication form before the new period.[1]
Although only the declaration is initially mandatory, attaching documents can speed up processing; if the operator is not the owner, provide the enabling legal title. If a representative files it, prove representation unless using a representative’s digital certificate.[1]
If you do not provide the required documentation with the declaration, you will be asked to submit it within 10 business days; if not provided, cancellation of the inscription will be initiated.[1]
Data about the dwelling in the declaration are public, except the phone number and email address.[3]
Set operating periods and climate control
If you operate in May to August, cooling is required; if you operate in December to March, heating is required.[1]
Minimum equipment and safety
The dwelling must be sufficiently furnished and equipped for immediate use, with a television, power sockets, and basic supplies of electricity and hot and cold water.[1]
Provide a smoke detector, one fire extinguisher, and selective waste separation.[1]
Obligations while hosting guests
Provide a 24-hour telephone number for incident resolution and clean the dwelling on guest arrival and departure.[3]
Keep official Complaints and Claims Forms and a visible notice in the dwelling.[3]
Include the registration code in the contract given to the guest and keep a signed copy for one year.[3]
Do not restrict access or service on grounds such as birth, race, sex, religion, opinion or other personal or social circumstances.[3]
Holders of tourist accommodation establishments must keep the tourist use registered and may not allocate them to another use during the registration’s validity.[2]
Inspections and sanctions
Starting the activity without filing the responsible declaration is clandestine activity and a serious infringement under the Tourism Act.[1][2][3]
Tourism inspection services may verify compliance, request corrections, and propose sanctioning procedures. The applicable sanctioning regime is Title VIII of the Tourism Act.[2][3]
Limitation periods apply: minor infringements six months, serious one year, and very serious two years.[2]
If inspection detects imminent risk of serious harm to users, precautionary measures must be proposed to the competent body.[2]
